Terms & Conditions for Papillon Pops

These Terms and Conditions (“Terms”) govern the purchase and use of products and services provided by [Papillon Pops] (“we,” “us,” or “our”). By placing an order, you agree to these Terms. Please read them carefully.

Orders
1.1 All orders are subject to availability and acceptance.
1.2 Custom orders must be confirmed in writing, including design, quantity, and pickup/delivery details.
1.3 Once an order is confirmed, changes may not be guaranteed and may incur additional charges.

Payments
2.1 Payment must be made in full before production begins unless otherwise agreed in writing.
2.2 Deposits for custom orders are non-refundable.
2.3. We reserve the right to cancel orders for non-payment.

Cancellations & Refunds
3.1 Cancellations made after order has been begun/crafted are non-refundable.
3.2 Due to the perishable nature of our products, all sales are final once the order has been picked up or delivered.
3.3 Refunds or replacements will only be issued for products that are proven to be defective or not as described.
3.4 We are not responsible for damage occurring after pickup or delivery (e.g., melting, smudging, breakage).

Allergies & Ingredients
4.1 Our products may contain or come into contact with milk, eggs, wheat, soy, nuts, and other allergens.
4.2 It is the customer’s responsibility to inform all consumers of potential allergens.
4.3 We are not liable for allergic reactions or health issues resulting from consumption.

Storage & Handling
5.1 Cake pops should be kept away from direct sunlight, moisture, and heat to prevent melting or softening.
5.2 Once the product is in the customer’s possession, the customer is responsible for proper storage.
5.3 We are not responsible for product condition after pickup/delivery.

Pickup & Delivery
6.1 Customers are responsible for providing accurate pickup or delivery information.
6.2 Delivery times are estimates and may vary due to traffic or weather conditions.
6.3 If the customer is unavailable at the scheduled delivery time, the product may be returned to the shop or left at the designated location at the customer’s risk.

Photos & Marketing
7.1 We reserve the right to photograph products for marketing, even if custom-made, unless otherwise requested in writing before production.
7.2 Customer photos sent to us may be used for promotional purposes unless the customer opts out in writing.

Limitation of Liability
8.1 We are not responsible for any indirect, incidental, or consequential damages related to the purchase or use of our products.
8.2 Our liability is limited to the value of the product purchased.

Governing Law
These Terms are governed by the laws of Indiana. Any disputes will be resolved in the courts of that state.
